While Tesoriero was possibly legally culpable for Karen’s injury, he also had the unenviable task of admitting to his employers that they were taken to court because of his negligence. To get out of at least one of those things, he allegedly misrepresented the facts.
After the landlords were understandably outraged at the situation, he wrote them that after the May email complaining about the light, there had been no other complaint until Karen’s fall. That was, of course, false, as her roommate complained again a month before the incident.
