Faced with mounting medical bills for a fall that was not even remotely her fault, Karen had little choice but to sue. In order to cover as much ground as possible, she sued all five of the building’s owners as well as two real estate agents – Tesoriero and another agent working for the Bondi Beach agency. In her suit, she claimed they all breached their duty of care for the building, which ended up leading to her injury.

Playing the blame game

Perhaps unsurprisingly, everyone blamed everyone else. The owners said the agents were completely liable for the damage since they never informed them of the broken lights – or fixed them – while the agents said they had an agreement that protected them from liability.
